EPR & Green Tax Advisory

EPR & Green Tax Advisory

We support our clients in identifying their Extended Producer Responsibility (EPR) obligations and meeting the related compliance requirements, including registration, reporting, and fee payment obligations. We also provide local representation services to foreign businesses subject to EPR requirements in Hungary, helping them navigate the applicable regulations and fulfil their obligations efficiently and in compliance with Hungarian law.

How Can We Help with EPR Advisory?

Identifying EPR Obligations

We learn about the business's activities and product portfolio, review the products it sells and distributes, and identify the packaging associated with them. On this basis, we identify the products and product streams relevant for EPR purposes.

Determining EPR Obligations and KF Codes

Based on the products and packaging identified, we determine which products and product streams fall within the scope of EPR regulations and assign the appropriate KF codes to the relevant items.

Fee Codes and EPR Records

Based on the KF codes, we identify the applicable fee codes for each product and its packaging and prepare the EPR records accordingly. These records provide a detailed, verifiable link between products, quantities, weight data, fee codes, and the EPR fees accounted for.

EPR Fee Calculation

Using the weight data provided, the identified fee codes, and the applicable EPR rates, we calculate the EPR fees payable for individual products and packaging, as well as the total obligations for the relevant period.

OKIR Reporting

Based on the prepared EPR records, we submit the required information through the OKIRkapu portal on behalf of the client, organising and uploading the data needed for the report.

Managing the OKIRkapu Portal

We manage the OKIRkapu portal as required to fulfil EPR reporting obligations, including logging into the system, completing the reporting process, and logging out of OKIRkapu once the activity giving rise to the EPR obligation has been completed.

EPR and Environmental Product Charges – Related Obligations

Joint Assessment of EPR and Environmental Product Charges

A business's environmental obligations cannot always be assessed separately under each regulatory framework. Alongside EPR obligations, we therefore also review the rules on environmental product charges.

As part of this work, we identify products subject to environmental product charges and determine the relevant KT codes. We also prepare the necessary records based on the applicable fee codes, calculate the product charges payable, and assist with the related reporting obligations.

Frequently Asked Questions

We have compiled answers to common questions about EPR obligations, reporting, and related environmental regulations.

When does a domestic sale of a product give rise to EPR obligations? +

When determining whether EPR obligations arise, the sale itself is not the only relevant factor. Consideration must also be given to whether the product falls within the scope of EPR regulations and the capacity in which the company acts in the transaction.

Can packaging give rise to EPR obligations even if the product itself is not subject to EPR? +

Yes. For EPR purposes, the obligations relating to a product and its packaging must also be assessed separately. As a result, a product may fall outside the scope of EPR while its packaging gives rise to EPR obligations.

When should EPR compliance be reviewed following a change in the product portfolio? +

Introducing a new product, changing an existing product's composition or packaging, or engaging a new supplier or partner may all affect EPR obligations. Following such changes, it is advisable to check whether the existing classification and EPR records remain appropriate.

Which data must be properly recorded for EPR reporting? +

To fulfil EPR obligations, businesses need data that makes it possible to determine, among other things, the relevant product stream, the quantity of the product or packaging, and the applicable fee rate. Proper record-keeping is particularly important for businesses with large or frequently changing product portfolios.
