How can we help?

R&D Potential Assessment and Preliminary Project Review

We assess the company’s research and development potential, review ongoing and planned projects, and identify development and innovation activities carried out within the business. We examine whether individual projects and activities may meet the statutory criteria for R&D and identify those that may qualify for R&D classification, tax benefits or other forms of support. The purpose of this preliminary review is to identify relevant R&D projects and opportunities before proceeding with formal project classification or a detailed assessment of tax options.

R&D Classification and Technical Documentation

We support the preparation of R&D project classification procedures before the National Research, Development and Innovation Office (NRDI Office), including the preparation of the technical content of the application. This may involve defining and describing the scientific field, project objectives and duration, the state of the art, the project’s novelty, and any existing scientific or technological uncertainties. We also assess the project’s own-activity criteria, intellectual property considerations, and the information needed to describe the R&D personnel involved, and use these inputs to prepare the supporting technical documentation for the application.

R&D Tax Incentives and Tax Opportunities

We review the tax options available in connection with R&D activities and help quantify and apply them. These may include a reduction of the corporate income tax base for direct R&D costs, social contribution tax relief related to R&D activities, and an assessment of eligibility for the R&D tax credit. We prepare the relevant calculations, evaluate whether the available options can be used together or as alternatives, and, where necessary, assist with reviewing previous tax returns and filing amended returns.

R&D Grants and Funding Opportunities

We help identify and assess Hungarian and EU funding opportunities related to R&D activities. We examine which funding schemes may be relevant to the business, the planned project and its costs, and review the requirements concerning R&D classification, eligible costs, aid intensity and state aid rules. We also provide support in assessing funding opportunities from a tax perspective and considering the implications of combining grants with tax incentives.

R&D Cost Analysis and Record-Keeping

We review the cost centres and cost items associated with R&D projects in detail and determine which may be treated as direct costs related to R&D activities. This includes personnel costs, material costs, costs associated with the use of assets, and other project expenses. We also assess whether each cost can be appropriately attributed to the relevant R&D project and is supported by adequate documentation. Where necessary, we recommend ways to establish or refine processes for identifying and recording R&D costs.

R&D Classification by the NRDI Office

As of 1 September 2023, under the legislation on research, development and innovation, the classification of R&D activities falls within the remit of the National Research, Development and Innovation Office (NRDI Office). During the classification procedure, the Office assesses whether the project or group of projects presented by the applicant meets the legal and technical criteria for research and development activities.

The classification procedure can assess not only whether an activity qualifies as R&D, but also, upon request, the proportions of basic research, applied research and experimental development, whether the R&D is carried out as the applicant’s own activity, and, in certain cases, the project’s classification in terms of market exploitation potential.

Project Classification

An assessment of a specific project to determine whether it qualifies as R&D. Related technical questions, such as the proportions of different R&D activities or whether the activity is carried out as the applicant’s own activity, may also be examined.

Project Group Classification

A procedure for classifying several projects grouped together as a single project group. If the classification is positive, the presumption that the projects qualify as R&D may extend to the projects included in the group.

Additional Assessments

Depending on the nature of the project and its intended use, it may also be necessary to assess the proportions of different R&D activities, whether the activity is carried out as the applicant’s own activity, or the project’s market exploitation potential.

TAX STRATEGY

Different R&D costs may qualify for different tax benefits.

The appropriate tax treatment must therefore be determined by considering the project’s technical classification, the nature of the cost, its direct connection with the R&D activity, the funding scheme applied, and the tax incentive selected by the taxpayer.

In practice, the same expenditure may have different tax consequences depending on the basis and regime under which it is recognised. We discuss this in more detail in our professional article:

R&D Tax Benefits: The Same Cost, Two Completely Different Tax Treatments

R&D Advisory in Practice

The tax treatment of R&D projects is properly supported when the project’s technical substance, classification, cost accounting, funding structure and internal documentation are consistent with one another. Our advisory work therefore considers the process as a whole rather than focusing solely on a single tax relief or the preparation of one document.

1. Initial Assessment

We review the company’s R&D projects, the technical substance of the activities and the potentially eligible costs.

2. Classification

We identify the appropriate classification procedure and support the preparation of the technical documentation required for the expert opinion.

3. Tax Optimisation

We assess the available R&D tax benefits, how they interact, and the tax treatment best suited to the business.

C&H PARTNERS

Comprehensive R&D support through a single integrated process.

We help identify the company’s R&D potential and related tax benefits, review and organise the project structure, and support the preparation of the classification procedure before the NRDI Office and the associated documentation.

Our support may also cover the design and review of processes for accounting for R&D costs, applying tax incentives and maintaining the related internal documentation.

Frequently Asked Questions

We have summarised key technical questions concerning R&D classification, project group classification, R&D tax incentives and the related cost accounting.

What criteria determine whether a project qualifies as research and development? +

R&D classification is not determined solely by the technology used or by whether a project appears innovative. The assessment focuses, among other things, on novelty, scientific or technological uncertainty, the methodology applied, the development objective and the intended scientific or technological advancement. Routine development or the straightforward adaptation of an existing solution therefore does not necessarily qualify as R&D.

What is the difference between individual R&D project classification and project group classification? +

Individual project classification assesses a specific project to determine whether it qualifies as R&D. Project group classification, by contrast, covers several projects grouped together by the applicant. The procedure has two stages: first, the project groups are approved and projects are selected; then the selected projects undergo a detailed assessment. If the classification is positive, the presumption that the activities qualify as R&D may apply to all projects within the group.

Is formal R&D classification mandatory to claim the R&D tax credit? +

Formal R&D classification is not a statutory requirement for claiming the R&D tax credit in every case, but it can provide significant technical evidence. During a tax audit, the tax authority may examine whether a project treated by the taxpayer as R&D actually met the statutory criteria. An expert opinion from the NRDI Office can therefore be an important means of substantiating the R&D activity, although all other requirements for the tax credit must still be met independently.

Which R&D costs may be taken into account for tax incentives? +

The costs that may be taken into account depend on the tax provision being applied. The assessment should distinguish between personnel expenses directly related to the project, material costs, costs of using assets and other expenses, and determine the extent to which each cost is genuinely connected with the R&D activity. Appropriate cost allocation and project-based record-keeping are therefore important practical requirements for claiming tax incentives.

Can the new R&D corporate income tax credit be used together with the previous tax base deduction? +

No. The R&D tax credit under the new Corporate Income Tax Act may be elected instead of the previous R&D tax base deductions. This is not an isolated decision relating to a single cost or project, so it is advisable to model the impact of the election over several tax years before determining the tax strategy.

Can R&D tax benefits be claimed for a project that also receives funding? +

This may be possible, but it is not automatic and does not apply in the same way to every cost. The rules of the relevant funding scheme, state aid limits, eligible costs and the prohibition on double funding must be examined. The tax treatment of costs covered by funding and those not covered by funding must therefore be determined with particular care.

When should an R&D classification application be submitted? +

The timing of R&D classification should be considered when the project and tax strategy are being designed. Early preparation helps ensure that the project’s technical substance, cost accounting and internal documentation are aligned from the outset with the requirements for R&D classification and tax treatment. Applying for classification at a later stage may also be relevant in certain cases, but well-prepared documentation from the beginning can make subsequent substantiation significantly easier.

What documentation is needed to substantiate the tax treatment of an R&D project? +

The required documentation depends on the nature of the project and the tax or funding provision applied. It may typically include the project’s technical description, documentation of development objectives and milestones, details of employees’ roles and time records, a breakdown of project costs, and records supporting the project results and development decisions. The key is to maintain a documented link between the project’s technical substance and the reported costs that can be reconstructed retrospectively.
